1. Acknowledgment of Company Policies
By proceeding with any booking through Palau Explorer, you acknowledge that you have read, understood, and agree to be bound by all company policies currently published on our website. These include:
- Booking & Payment Policy: Governs reservation processes, payment methods, and financial transactions
- Cancellation & Refund Policy: Outlines conditions for tour cancellations and refund eligibility
- Privacy Policy: Details how personal information is collected, used, and protected
- Terms & Conditions: This governing document outlining participant responsibilities
- Health & Safety Policy: Specifies safety protocols, equipment requirements, and emergency procedures
- Weather & Activity Policy: Explains how tours are conducted under varying weather conditions and activity parameters
Electronic Acceptance: Your electronic signature (via booking confirmation) constitutes agreement to these terms. It is recommended that you save copies of all policies for future reference.
2. Participant Responsibilities
Participants must adhere to the following guidelines:
- Follow all safety instructions provided by Palau Explorer staff
- Disclose any medical conditions or physical limitations before tour commencement
- Refrain from actions that endanger personal safety or the safety of others
- Comply with all local laws and cultural norms during tours
- Arrive punctually for all scheduled activities
Liability: Participants assume responsibility for personal belongings and any damage caused by intentional misconduct.
3. Liability Waiver
Participants release Palau Explorer from liability for injuries or damages arising from:
- Acts of God or natural phenomena beyond our control
- Participant negligence or failure to follow safety protocols
- Unforeseen circumstances affecting tour operations
Insurance Requirement: It is recommended that participants carry adequate travel insurance covering adventure activities.
4. Insurance Requirements
While not mandatory, Palau Explorer strongly recommends that all participants obtain:
- Comprehensive travel insurance covering medical evacuation
- Adventure sports coverage for water-based activities
- Personal accident insurance for high-risk excursions
Proof of Coverage: Participants may be asked to provide proof of insurance upon request.
5. Environmental Protection
Palau Explorer is committed to sustainable tourism. Participants must:
- Not remove or disturb marine life or coral formations
- Dispose of trash properly (no littering in oceans or on land)
- Follow all guidelines for interacting with wildlife
- Respect protected areas and cultural sites
Fines: Violations of environmental protection laws may result in fines payable by the participant.
6. Cultural Respect & Etiquette
Palau's rich cultural heritage is central to our identity and the experiences we offer. Participants engaging in cultural tours must:
- Dress modestly and appropriately for cultural sites (cover shoulders and knees, avoid revealing clothing)
- Remove footwear when entering traditional buildings or sacred spaces
- Ask permission before photographing people or culturally significant artifacts
- Listen attentively to guides and elders during explanations
- Avoid touching or handling sacred objects unless explicitly permitted
- Refrain from loud or disruptive behavior during ceremonies or rituals
Cultural Sensitivity: Palauan culture places great value on respect and humility. Participants showing disrespect may be excluded from cultural activities and could face local community sanctions.
7. Miscellaneous Provisions
7.1 Photo & Video Release
By participating in tours, you grant Palau Explorer permission to use images/videos of you for promotional purposes unless otherwise specified in writing.
7.2 Modifications to Services
Palau Explorer reserves the right to modify or cancel services due to weather, safety concerns, or logistical issues. Participants will be notified promptly of any changes.
7.3 Age Restrictions
Some tours have minimum age requirements. Participants under 18 must be accompanied by a parent or guardian.
Age Verification: Proof of age may be required for certain activities.
8. Governing Law
These Terms & Conditions are governed by the laws of Palau. Any disputes shall be resolved in the courts of Koror, Palau.
